What you agree to when you use Smara, and what we promise in return. Written to be read, not skimmed past.

These terms are the agreement between you and Smara Intelligence Pvt Ltd, India ("Smara", "we") when you create an account, install the widget, use the API or talk to one of our demos. If you use Smara for a company, you agree for that company and confirm you may do so.
Keep your login and API keys private: anything done with them counts as done by you. API keys are shown once; if one leaks, revoke it in the studio and create another. Tell us straight away at security@smaralive.com if you think your account has been misused.
The free plan and the demos on our site are for trying Smara. Demos are limited in time and number per visitor, and we may change or stop them. Please do not use them to run a business.
You own what you give us: your business information, your website content, the recordings and photos of the people in your custom avatars, and the conversations on your site. You allow us to use it only to run Smara for you, and you confirm you have the right to give it to us. A custom avatar made from your recording is yours to use through Smara; we delete it when you ask or when your account closes.
Smara's software, engine, models, stock avatars, voices and website belong to us or our licensors. Your plan gives you the right to use them through Smara while your account is active, and nothing more.
The avatar answers from the information you give it and is told not to guess prices, times or policies it was not given. Like every AI system it can still get things wrong. Check its setup, keep your fact sheet current, and do not rely on it for medical, legal or financial decisions. You are responsible for the information your avatar gives your visitors.
We work to keep Smara available and fast, but the Free, Starter and Growth plans have no guaranteed uptime. We may improve or change features; if we remove something you rely on, we tell you first. Scale and custom agreements can include a written service level.
You can cancel any time in the studio. Your plan stays active until the end of the period you paid for, and then stops renewing. We may end or suspend an account that seriously or repeatedly breaks these terms. Refunds are covered by the refund policy. After an account closes, conversations are deleted within 30 days, as the privacy page describes.
Smara is provided as it is. To the extent the law allows, we are not liable for indirect or consequential losses such as lost profits or data, and our total liability for any claim is limited to what you paid us in the 12 months before it. Nothing here limits liability that cannot legally be limited.
These terms are governed by the laws of India, and the courts of India have jurisdiction. If we change them in a way that matters, we email account holders before the change takes effect. Questions to hello@smaralive.com.
